Landlord and tenant forms on Florida Bar website

TALLAHASSEE, Fla. – June 8, 2010 –The Florida Supreme Court’s newly approved landlord-tenant forms, including some not offered on floridarealtors.org, are now available to the public on The Florida Bar’s website : http://www.floridabar.org/consumerpamphlets.

The documents are designed for use in common landlord-tenant matters. They include:

• Residential Landlord-Tenant Eviction Forms
• Residential Lease for Single Family Home and Duplex
• Residential Lease for Apartment or Unit in Multi-Family Rental Housing

According to The Florida Bar, the forms are not meant to be a complete summary of Florida’s landlord-tenant laws, or provide legal advice – only a lawyer can do that. With the new forms, however, non-lawyers may assist consumers filling them out, and they may answer general questions. But non-lawyers cannot give advice on what to write in the forms or about any decisions a consumer should make.

Last year, The Florida Bar filed a petition with the court recommending amendments to several residential lease forms. The Bar’s Real Property, Probate and Trust Law Section (RPPTL) had proposed the amendments after seeking opinions from Florida Realtors® and the Housing Group of Florida Legal Services.

As part of the revisions, the 1992 versions of the forms on leasing either a condominium or a single-family home or duplex were eliminated. Additionally, the RPPTL Section prepared instructions to accompany some of the forms.

The documents can be downloaded and printed in PDF format. For additional information, refer to Chapter 83 of the Florida Statutes.
